I. OVERVIEW

CashFinders.net (“web site”) is Cash Finders LLC (“company”, “our”, “us”, “we”), a registered LLC, and is subject to its participants (“user”, “users”, “you”, “your”, “yourself” “their”). By accessing and using cashfinders.net, or otherwise availing yourself of the services and information offered through the web site, you agree to these Terms of Service in effect at the time of each such access or use.

At the behest of Cash Finders and with the cooperation of the respective participants, CashFinders.net provides an initial search inquiry located at the top of the web site’s homepage. Voluntary completion of the search form allows for Cash Finders to use the information entered by users to search for their missing money. If the user is indeed subject to missing money, the user is notified by Cash Finders through the contact information the user has provided on the next steps required to claim the lost funds.

II. TERMS AND CONDITIONS

1.Successive agreements

Completion of the initial survey form on the top home page is the beginning of our correspondence. If when you complete the survey, we find missing money in your name, you will be emailed with the option to continue an extenuated search. Should you decide that you want Cash Finders to continue finding your missing money, a written agreement would be entered in to and you will need to provide physical documents verifying your identity (e.g. driver’s license, birth certificate, proof of address, any supporting documents etc.) to rightfully claim your lost funds. Missing money can be missing in trust funds, court funds, tax returns, dividends, estate proceeds, insurance benefits/policies, stocks, bonds, mutual funds, telephone/utility/security deposits, bank accounts – savings, checking and CDs, the list continues.

2. Fees

CashFinders.net is a no charge website. Users are allowed to voluntary complete the inquiry form located on the top home page free of charge and submission of the inquiry form grants us permission to conduct a search for your missing money. Cash Finders does not charge any up-front finding fees upon the initial survey, signing of written agreement, or during the process of corresponding with those that are holding your missing money. Users may be subject to a notary fee upon signing our written agreement which is meant to protect both parties in the claiming of lost funds. In the event, that a successful claim is processed, and a check is issued in your name, no more than 15% of the funds will be allocated to us for our services. Payment of the allocated funds will be due upon receiving the missing funds. If, for instance, you would like to use the missing funds as payment, you agree to open a bank account in escrow by which when the funds clear, the percentage agreed upon prior will be withdrawn by Cash Finders, with the remaining balance withdrawn by you, thus closing the account from further use.

3. Guarantees

Cash Finders does not guarantee that you have missing money. Cash Finders provides users the ability to allow us to search on your behalf for missing money, should there be any money missing. In the event, a search is conducted, and missing money is suspected to be in your name, Cash Finders will contact you via the contact information which you provided on the next steps to claiming your money. Cash Finders does not guarantee that claiming your money will indeed be successful. As users, you understand and accept and release legal liability thereof that Cash Finders does not make certain that you are missing money. Cash Finders does not guarantee that claiming the missing money will in fact be returned to you. In some cases, if you were found delinquent on previous owned accounts, before the missing money is returned, the delinquency may be paid with the missing money found. For example, you have missing money from IRS from 2016 owed to you, however you owe taxes for your 2017 tax filing. IRS may deduct from your missing money found from your 2016 tax filing to rectify debt on your 2017 tax filing.

4. Refusal of Our Services to a User

Cash Finders does not and shall not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, or military status, in any of its activities or operations. However, Cash Finders will not knowingly conduct correspondence and services with minors. Cash Finders will not pursue claims by which a user cannot provide physical documentation of their identity. In the event, that participants cannot provide proof that links the participant to their missing money, whereby it is determined that such documentation is necessary during the process of retrieving a participant’s missing funds, Cash Finders may be unable to pursue the missing funds and our written contract may be found null and void. Cash Finders will not pursue claims that require the use of a probate attorney.

5. Timeline for Receiving Missing Funds

If Cash Finders finds that you have missing money waiting to be claimed, from the time an application for such funds is made, Cash Finders does not guarantee any specific timeline. Your missing funds can take anywhere from a few days, few months, or few years to be retrieved. The timeline in receiving your funds is affected by how soon you can provide specific documentation necessary for retrieval of your claim.

6. Search Results Not to be Sold or Resold
This web site is intended only for private use by Cash Finders and the public. All information collected from participants is kept confidential and we do not exploit or sell any portion of our user’s information.

7. Means of Query Input
Users of CashFinders.net are voluntarily subject to completing an initial search form providing their information for our services of searching and locating each user’s lost money. Without completion of the initial form located at the top of the web site’s home page, services cannot commence. The completed initial form will need to be completed with the use of a query input (i.e. QWERTY keyboard or mobile device by which characters can be inputted into each section of the form). In formulating the initial search queries or otherwise carrying out searches on this web site, under no circumstances may any user utilize robots, spiders, bots, agents, or any other such software or application designed to perform multiple or repeated searches by circumventing the need for manual entry in a malicious attempt.

8. Subscriptions
Cash Finders does not offer subscriptions or collects any fees for subscriptions.

9. Availability and Access
Cash Finders makes no guarantees regarding the availability of the web site or the services. Furthermore, Cash Finders reserves the right, within its sole discretion, to discontinue the web site or services and/or modify the contents of the web site or the terms of the services as it sees fit. You agree that Cash Finders will not be liable to you for any such discontinuance or modification of the web site or services. Your access to the web site, and the services is at the sole discretion of Cash Finders and may be discontinued at any time for any reason. All written agreements will be honored regardless of website discontinuance and are subject to the terms of the written agreement.

10. Linking (To & From) The Web Site Advertisers
CashFinders.net does not provide links to other websites nor advertises for other websites. Should you find yourself on a third-party website, you are subjected to the terms of service and privacy policy of that third-party site.

11. Privacy Policy
This web site’s privacy policy shall govern the maintenance and use of CashFinders.net. All user-provided information is hereby incorporated by reference as a part of this agreement and is also subject to these terms of service.

12. Prohibition Against Harmful Transmissions
You agree that you will not upload, post, email, or otherwise transmit to the web site or to any other user any messages, programs, or other materials (including but not limited to trojan horses, viruses, worms, and the like) that contain software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or telecommunications equipment.

13. No Warranties
NEITHER CASHFINDERS NOR ANY OF ITS UNDERLYING SERVICE PROVIDERS, INFORMATION PROVIDERS, LICENSEES, EMPLOYEES, OFFICERS, DIRECTORS, ASSIGNEES, OR AGENTS, INCLUDING BUT NOT LIMITED TO CASHFINDERS AND PARTICIPANTS, (A) WARRANT THAT THE WEB SITE-RELATED SERVICES WILL BE UNINTERRUPTED OR ERROR FREE OR THAT THE FUNCTIONS AVAILABLE ON THE WEB SITE WILL MEET THE REQUIREMENTS; OR (B) GUARANTEE THE ACCURACY OF ANY INFORMATION PROVIDED ON THE WEB SITE. THE SERVICES ARE DISTRIBUTED "AS IS," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT, ALL SUCH WARRANTIES BEING EXPRESSLY DISCLAIMED. NEITHER CASHFINDERS NOR ANY OF ITS UNDERLYING SERVICE PROVIDERS, INFORMATION PROVIDERS, LICENSEES, EMPLOYEES, OFFICERS, DIRECTORS, ASSIGNEES, OR AGENTS, INCLUDING BUT NOT LIMITED TO CASHFINDERS AND PARTICIPANTS, SHALL HAVE ANY LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SPECIAL DAMAGES SUFFERED BY YOU OR ANY OTHER PARTY AS A RESULT OF THE OPERATION OR MALFUNCTION OF THE WEB SITE-RELATED SERVICES, REGARDLESS OF WHETHER OR NOT SUCH PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FINALLY, IN ADDITION TO THE FOREGOING DISCLAIMERS, YOU ACKNOWLEDGE THAT THE RAW DATA THAT ULTIMATELY IS ENTERED IN TO THE WEB SITE IS GATHERED FROM PARTICIPANTS AND ACCORDINGLY THAT CASHFINDERS IS NOT HELD LIABLE TO YOU OR ANY OTHERS IN RELATION TO THIRD-PARTY COMPANIES UNLESS IN PURSUIT OF CLAIMING YOUR LOST MONIES BY WHICH A WRITTEN AGREEMENTS SIGNED BY BOTH PARTIES IS IN EFFECT.

14. Limitation Of Liability
NEITHER CASHFINDERS NOR PARTICIPANTS SHALL HAVE LIABILITY FOR UNAUTHORIZED THIRD-PARTY (AN ENTITY OTHER THAN CASHFINDERS) ACCESS TO, OR ALTERATION, THEFT OR DESTRUCTION OF, ANY INFORMATION CONTAINED AT THE WEB SITE (INCLUDING USER DATA AND INFORMATION) THROUGH ACCIDENT OR THROUGH FRAUDULENT OR WRONGFUL MEANS OR DEVICES. CASHFINDERS SHALL HAVE NO LIABILITY WITH RESPECT TO CASHFINDERS OFFERINGS UNDER THIS AGREEMENT OR IN RELATION IN ANY WAY TO THE WEB SITE FOR CONSEQUENTIAL, EXEMPLARY, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES EVEN IF CASHFINDERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, THE LIABILITY OF CASHFINDERS AND/OR PARTICIPANT TO YOU OR ANY OTHER USER FOR ANY REASON AND UPON ANY CAUSE OF ACTION SHALL BE LIMITED TO AND SHALL IN NO EVENT EXCEED THE SUM OF ONE-HUNDRED DOLLARS ($100.00). THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE, INCLUDING, WITHOUT LIMITATION, TO BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATIONS, AND OTHER TORTS.

15. Indemnification
You agree to indemnify, defend, and hold harmless Cash Finders, as well as their directors, officers, employees, assignees, and agents, and defend any action brought against same with respect to any claim, demand, cause of action, debt or liability, including reasonable attorney fees, to the extent that such action is based upon a claim that: (i) if true, would constitute a breach of any of your representations, warranties, or agreements hereunder; and/or (ii) arises out of your negligence, willful misconduct, or other breach of this agreement and/or (iii) arises out of your submission on the web site any content or information; and/or (iv) arises out of your use of the web site, and/or the services. You shall cooperate fully in any defense of such claim. Cash Finders reserves the right to take exclusive control over the defense of any such claim.

16. Severability
In the event that one or more of the words, phrases, sentences, clauses, sections, subdivisions or subparagraphs contained herein shall be held invalid, this agreement shall be construed as if such invalid portion had not been inserted. In the event that any invalid language is severed under this paragraph, the severed language shall be comprised of the smallest unit possible such that the severance of the unit results in a valid provision (i.e., a single item in a list will be severed rather than the entire list, a clause will be severed rather than the entire sentence, etc.).

17. Entire Agreement
This agreement sets forth and contains the entire agreement with regard to the matters set forth herein between you, Cash Finders and the CashFinders.net site. There are no promises, terms, conditions, or obligations except for those contained herein in regard to the CashFinder.net site. All written agreements that both parties, both user and Cash Finders enter in to are considered an addendum to the terms of service of CashFinders.net.

18. Choice Of Law

This agreement, and any disputes arising from, relating to, or touching upon the agreement and/or the subject-matter hereof, shall be construed under and governed by the law of the State of New York, County of Kings.

19. Choice Of Venue And Acknowledgment Of Personal Jurisdiction
Any action at law, suit in equity, or other judicial proceeding concerning, relating to, or touching upon in any way this agreement or the subject-matter hereof, shall be brought or commenced, if at all, only in the Commonwealth of New York, County of Kings. You acknowledge the right of the specified court to assert personal jurisdiction in any such action over you and waive and release now and forever any defense to that assertion of jurisdiction that might otherwise exist.

20. Waiver
The waiver by one party of a breach of any provision of this agreement by the other party shall not operate or be construed as a waiver of any subsequent breach of the same or any other provision by the other party. The failure of a party at any time to require performance of any provision hereof shall in no manner affect its right at a later time to enforce the same.

22. Prohibited Conduct
Use of this web site or the corresponding services for any use or reason other than the intended and permissible uses set forth herein and in the text of the web site ("authorized uses") is expressly prohibited. Any use or access other than an authorized use constitutes violation of state and federal civil and criminal laws and may result in civil and/or criminal prosecution. Furthermore, without limiting other remedies, Cash Finders may immediately issue a warning and/or temporarily or indefinitely suspend or terminate your privilege to use and access the web site if you: (1) breach this agreement; (2) provide incorrect member information; and/or (3) take actions that Cash Finders believes may result in legal liability for you, for Cash Finders, and for any participant or for other web site users.

23. Right to Change Agreement
Cash Finders reserves the right to change this agreement at any time. Your continued use of the web site after any such change is made constitutes acceptance of and agreement to be bound by the terms of the agreement as modified. Only Cash Finders can modify the terms and conditions of this agreement.

24. Termination
Cash Finders reserves the right to terminate this agreement at any time for any reason whatsoever and to revoke your access to the web site, and the services without prior notice to you.

This privacy notice applies solely to information collected by this website, except where stated otherwise. It will notify you of the following:

1. Information Collection, Use, and Sharing
We are the sole owners of the information collected on this site. We only have access to collect information that you voluntarily give us via email or other direct contact from you. You may opt out of any future contacts from us before a service agreement is signed. You may also e-mail us at that same address to change or correct any data we have about you. If in the event, a service agreement has been entered in to and we are in the process of recovering your lost money, we will continue to contact you in order to return the missing money to your possession. When that occurs, we will then cease further contact with you. If, before a signed agreement is entered in to, you decide that you want to immediately cease services, please e-mail us at info@cashfinders.net with subject heading “Cease Services”. We will then cease communication and services at your request.

3. Retention of Information

We keep your personal information for no longer than necessary for the purposes for which it is processed. The length of time for which we retain information depends on the purposes for which we collected and use it and/or as required to comply with applicable laws. Where there are technical limitations that prevent deletion or anonymization, we safeguard personal data and limit active use of it.

4. Registration

No registration is required in the form of a log in with a password. However, in order to use this website fully and the services it provides, a user must first complete the survey located on the top home page. A user is required to give certain information (such as name and email address). This information is used to contact you about the products/services on our site in which you have expressed interest. You are also asked to provide demographic information (such as age) about yourself which will aid in our search for your missing money. We do not nor do we support discrimination on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, or military status, in any of its activities or operations. We do however, abstain from providing services to minors and to users outside of the United States of America

5. Surveys

Our site requests information via a survey located on the top home page. Participation in this survey is completely voluntary and you may choose whether or not to participate and therefore disclose your information. Information requested may include contact information (such as name and address), and demographic information (such as zip code, age). Contact information will be used for future correspondence. You must be 18 years and older to participate in the survey. If we find that you are a minor, we will cease services. Survey information will be used for purposes of finding your missing money.

6. Children's Privacy

Our Services are not designed for and are not marketed to people under the age of 18 (“minors”). We do not knowingly collect or ask for information from minors. We do not knowingly allow minors to use our Services. If you are a minor, please do not use our Services or send us your information. We delete information that we learn is collected from a minor without verified parental consent. Please contact us at info@cashfinders.net with a subject heading of “Minor” if you believe we might have information from or about a minor.

7. Users From Outside the United States and in United States

We do not provide services to users outside of the United States. However, we may be able to provide information to users outside of USA as to where to locate missing money if one previously resided in the USA.

9. Sharing
We do not share demographic and/or personally identifiable information except for the purpose of submitting claims on your behalf to recuperate your missing money. In this event, you will be notified and asked to sign a written consent in order for our services to proceed. There may be an instance where a user is requested to provide a testimonial. Such testimonial will be a willful act on the behalf of the user and a written consent to post the testimonial on our site will be agreed upon before such act occurs.

10. Security
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Wherever we collect sensitive information (such as address, phone, e-mail), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the URL section of your web browser or looking for "https" at the beginning of the address of the web page. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (e.g. finding your missing money) are granted access to personally identifiable information. For this reason, we are not able to guarantee that information we collect, or store will always be protected from unauthorized access. In the event, there is a security breech, you will be notified immediately.

12. Cookies
We do not use "cookies" on this site. A cookie is a piece of data stored on a site visitor's hard drive to help us improve your access to the site and identify repeat visitors to the site. For instance, when a cookie is used to identify you, you would not have to log in a password more than once. Cookies can also enable a company to track and target the interests of users to enhance their experience on the site. Cashfinders.net requires only for an initial survey be completed and future correspondence is conducted off the site. You will not need to maintain a login and password for usage of our site.

This web site does not contain links to other sites. Please be aware that we are not responsible for the content or privacy practices of any other site but our own. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information.
